These Terms of Service ("Terms") govern your use of BLNKBooks (available at www.blnkbooks.com and any associated domains, collectively "the Service"). You agree to these Terms when you tick the box confirming that you accept them and submit it, which we ask you to do before you can upload a photo or place an order. Browsing the site alone does not bind you to these Terms. If you do not agree to them, do not tick the box, and do not upload photos or place an order.
What these Terms include. Our Privacy Policy and Refund & Return Policy form part of your agreement with BLNKBooks. A material change to any of them is treated as a material change to these Terms and follows the procedure below.
Changes to These Terms. The version of these Terms that you affirmatively accept is recorded with your account. The version accepted when you place an order governs that order unless a change is required by law or you and BLNKBooks expressly agree otherwise.
We may update these Terms prospectively. If a change is material, we will provide reasonable notice and require you to affirmatively accept the revised Terms before placing another order or continuing to use features affected by the change. Continued browsing alone does not constitute acceptance of a material change.
Nonmaterial changes, such as corrections, clarifications, or updated contact information, become effective when posted and will be identified by the "Last updated" date.
We will not apply a material change retroactively to conduct or disputes that arose before you accepted the revised Terms.
You must be at least 18 years old and legally capable of entering into a binding contract to create an account, upload photographs, or place an order. BLNKBooks is intended for adult customers and is not offered directly to children under 13.
If an uploaded photograph depicts a minor, you represent that you are the minor's parent or legal guardian or have obtained permission from the minor's parent or legal guardian sufficient to authorize the processing, transformation, and fulfillment described in these Terms and the Privacy Policy.
Geographic Availability. The Service is offered only to customers located in the fifty United States and the District of Columbia. We do not accept orders for delivery outside that area or make digital products available to customers outside that area. You may not access or use the Service in violation of applicable export, sanctions, or other laws. We may refuse or cancel an order that does not satisfy these geographic requirements.
BLNKBooks is a service operated by BLNKBooks LLC, a Florida limited liability company. It is an AI-powered service that transforms user-uploaded photos into coloring book pages ("coloring pages"). Users may download their coloring pages digitally or order them as physically printed products via third-party print-on-demand partners.
The Service is provided for personal use by the uploader. Commercial use is limited to the coloring pages included in an order you have purchased, on the terms set out in AI-Generated Output Rights below.
When you upload a photo to BLNKBooks, you represent and warrant that:
You retain ownership of your uploaded photos. By uploading a photo, you grant BLNKBooks a limited, non-exclusive license to host, copy, transmit, process, transform, and disclose the photo only as reasonably necessary to:
This license lasts only as long as reasonably necessary for those purposes and the retention periods described in our Privacy Policy.
We do not sell your photos, use them for advertising, or use them to train AI models. We disclose them only to service providers and authorities as described in our Privacy Policy or as otherwise required by law. The AI services that process them do not use your photos for training under the paid API terms that govern our use of those services.
Source photographs are stored for up to 90 days after generation, subject to earlier deletion requests and legally required holds — see our Privacy Policy — Data Retention.
BLNKBooks does not pre-screen uploaded content for copyright infringement. You agree to:
Your responsibility for third-party claims. To the extent permitted by law, you are responsible for third-party claims, losses, and reasonable legal fees to the extent they result from your unlawful or unauthorized content, your material breach of these Terms, or your infringement of another person's rights. You are not responsible for a claim to the extent it was caused by BLNKBooks' breach of these Terms, negligence, willful misconduct, or failure to follow its stated privacy or security practices. BLNKBooks will give you prompt notice of a covered claim and reasonably cooperate in its defense. You may not settle a claim in a way that imposes an obligation or admission on BLNKBooks without BLNKBooks' written consent.
Reporting infringement. If you believe content on the Service infringes a copyright you own or are authorized to act for, send a written notice to our designated agent, below. Under 17 U.S.C. § 512(c)(3), that notice must include: your physical or electronic signature; identification of the copyrighted work you say has been infringed; identification of the material you say is infringing, with enough detail for us to find it; your address, telephone number, and email address; a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.
If we remove something you uploaded: counter-notice. We will make a reasonable effort to tell you when we remove or disable content you uploaded in response to a notice. You may dispute it by sending a counter-notice to the same agent. Under 17 U.S.C. § 512(g)(3), a counter-notice must include: your physical or electronic signature; identification of the material and where it appeared before it was removed; a statement, made under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification; and your name, address, and telephone number, together with a statement that you consent to the jurisdiction of the federal district court for the district where you live (or, if you live outside the United States, for any district in which BLNKBooks may be found) and that you will accept service of process from the person who gave the original notice. We will forward your counter-notice to that person. Unless they tell us within ten business days that they have filed an action seeking a court order to stop you, we may restore the material between ten and fourteen business days after we receive your counter-notice.
Claims made in bad faith. Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing — or that it was removed by mistake — may be liable for the resulting damages, including costs and legal fees.
By uploading photos containing identifiable individuals, you represent and warrant that:
Permission to process a photo of a person, including a parent's or guardian's permission for a minor, does not by itself give you copyright, publicity, or other rights in that photo that you do not otherwise have.
BLNKBooks takes the protection of minors seriously. We reserve the right to remove content and terminate accounts that we believe violate these provisions.
Creating a preview is free, subject to daily limits. You review a watermarked version of your coloring page first, and you only pay if you want the clean, watermark-free file. Payment is for the download — not for the generation.
Once a functioning digital file that materially conforms to the approved preview has been delivered, the sale is final except where applicable law requires otherwise. The file is custom-generated for your order and delivered immediately. This does not limit any remedy available if the file is blank, corrupted, materially different from the approved design, or not delivered as promised.
A preview is a screen representation of the final file. Because it may be watermarked, displayed at a reduced resolution, or viewed on a particular screen, fine lines and other details may appear somewhat different in the downloaded or printed version. Approving a preview does not limit any remedy available when the delivered file is blank, corrupted, materially different from the approved design for reasons other than ordinary resolution or display differences, or otherwise not delivered as promised.

Coloring pages are generated by software from the photos you upload. The following applies to them:
The license above is a contractual permission to use what you purchased. BLNKBooks does not promise that a generated output is protected by copyright, that you will own a copyright in it, or that your use of it will be exclusive.
Physical printed products (printed coloring books, prints, etc.) are fulfilled by third-party print-on-demand partners. By placing a print order, you acknowledge and agree to the following:

You may not upload, submit, or request generation of content that:
Violations will result in immediate account termination and may be reported to relevant law enforcement authorities.
Child sexual abuse material. Photos you upload are automatically checked against lists of digital fingerprints of known child sexual abuse material before they are processed. This is an automated comparison against already-known illegal images: the screening itself does not involve routine human review of your photos, and the check is not used to analyze or profile them. It is not the only circumstance in which an image may be seen — the limited cases where authorized personnel or service providers may access one are set out in our Privacy Policy — Automated Processing and Limited Human Access. Where we become aware of apparent child sexual abuse material, we report it to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement as required by law (18 U.S.C. § 2258A), preserve the material and related records as the law requires, and terminate the account.
BLNKBooks reserves the right to suspend or terminate your access to the Service at any time, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service ceases immediately.
You may stop using the Service at any time.
Repeat infringers. BLNKBooks keeps a record of the copyright notices it receives and acts on, and will terminate, in appropriate circumstances, the accounts of users who repeatedly infringe the copyright of others. We weigh each notice on its own facts. An account that is the subject of more than one notice we have acted on is considered for termination; in deciding, we take into account whether the material was restored following a counter-notice, whether a notice was withdrawn or appears abusive, and the nature and seriousness of the use. A count of notices alone neither ends an account nor preserves one, and a single notice may be enough where the circumstances warrant it.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC REQUIREMENTS. This disclaimer applies to the online Service and its digital functionality; it does not disclaim warranties applicable to printed products.
The exclusions and limitations in this Section do not limit liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, product liability, violation of a nonwaivable consumer-protection right, or other liability that applicable law does not permit to be excluded or limited. They also do not limit damages arising from BLNKBooks' violation of applicable privacy or data-protection law, or from BLNKBooks' failure to use reasonable security measures that results in unauthorized access to, acquisition, use, or disclosure of personal information.
Subject to the preceding paragraph, BLNKBooks will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Service or any product.
Subject to the preceding paragraph, BLNKBooks' aggregate liability arising out of or relating to the Service, products, or these Terms will not exceed the greater of $100 or the amount you paid to BLNKBooks for the order giving rise to the claim. Where a claim does not arise from a particular order, the limit is $100.
Printed products. Nothing in these Terms or the Refund & Return Policy excludes or modifies an implied warranty or remedy applicable to a printed product where that exclusion or modification is not permitted by law. The return process in the Refund & Return Policy does not limit rights or remedies that cannot lawfully be excluded.
Some jurisdictions do not permit particular exclusions or limitations. In those jurisdictions, these limitations apply only to the extent permitted by law and do not affect rights that cannot be waived.

These Terms and any dispute arising out of or relating to these Terms, the Services, or a purchase from BLNKBooks are governed by Florida law, without regard to its conflict-of-law rules, except that this choice of law does not deprive you of any consumer protection that cannot lawfully be waived under the law applicable to you.
Any dispute may be brought in a court of competent jurisdiction. Nothing in these Terms requires either party to arbitrate a dispute or waives any right either party may have to a jury trial or to bring or participate in a class, collective, or representative action, to the extent those rights are available under applicable law. The parties may agree to mediation or arbitration after a dispute arises.
